1. Introduction
Welcome to PublicServiceGrove ("we," "us," or "our"). These Terms & Conditions ("Terms") are a contract between you and us and govern your use of our yacht charter services and the Service found at publicservicegrove.sbs, maintained by PublicServiceGrove.
By reserving a charter or utilizing our Service, you consent to these Terms. If you do not accept any part of these terms, you should not use the Service.
2. Service Overview
PublicServiceGrove offers a variety of high-end yacht charter services, including:
- Yacht rentals for the day
- Evening boat trips
- Business getaways
- Exclusive functions
- Extended charter experiences
Availability of services depends on various factors and may change. We have the authority to alter or halt services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Requirements for chartering include:
- A minimum age of 18 years
- Provision of valid and comprehensive details
- Payment of a stipulated advance as indicated in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A reservation is deemed confirmed upon successful payment processing and issuance of our confirmation in writing. We retain the right to reject service provision to any individual at our sole discretion.
3.3 Availability
Charter availability hinges on the availability of vessels and favorable weather conditions. We commit to making earnest attempts to accommodate requested dates and times.
4. Payment Terms
4.1 Pricing
All charges are presented in € and are inclusive of applicable taxes unless stated otherwise. Prices may be adjusted without prior notification.
4.2 Payment Schedule
- Initial Payment: 50% of the overall charter fee, payable at the time of reservation
- Remaining Balance: Payable 48 hours prior to the charter's commencement
- Additional fees (if applicable): Payable after the charter concludes
4.3 Payment Methods
We accept several forms of payment, including major credit cards, wire transfers, and certified bank drafts. Payment processing is performed using secure and encrypted means.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours before departure: Full refund, less processing charges
- Between 24 and 72 hours prior to departure: 50% refund
- If less than 24 hours before departure: No refund given
5.2 Weather Cancellations
Should our captain deem weather conditions unsafe, we will propose to either:
- Move your charter to another suitable date at no extra cost
- Issue a full refund when rescheduling is not feasible
5.3 Mechanical Issues
Should mechanical difficulties arise with the assigned yacht, efforts will be made to arrange an appropriate replacement. If a replacement cannot be provided, you will receive a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All customers must:
- Comply with instructions given by the crew
- Wear necessary safety gear as instructed
- Inform us of any health conditions impacting their safety
- Stay within the designated areas on the boat
6.2 Prohibited Items
Certain items are forbidden onboard:
- Containers made of glass
- Illegal drugs
- Weapons or firearms
- Unapproved animals (exceptions made for pre-approved cases)
6.3 Conduct
Behavior of guests should be respectful at all times. A charter may be terminated prematurely without a refund if the behavior of any passenger poses a safety threat or detracts from the experience of other customers.
7. Liability and Insurance
7.1 Our Liability
Our financial responsibility is capped at the charter fee paid. We are not liable for:
- Injury arising from passenger carelessness
- Loss or destruction of personal effects
- Consequential, indirect, or punitive damages
- Delays as a result of weather or circumstances outside our control
7.2 Insurance Coverage
Comprehensive marine insurance for our vessels and operations is in place. Personal travel and belongings insurance is the passenger's own responsibility.
7.3 Assumption of Risk
You acknowledge that engaging in marine activities entails inherent danger, and by using our charter services, you accept the risks associated with your safety and welfare.
8. Modifications and Itinerary Changes
We retain the prerogative to alter itineraries, paths, or schedules due to weather, safety considerations, or other operational needs. Efforts are made to offer similar alternative experiences when possible.
9. Force Majeure
We are not responsible for delays, cancellations, or changes stemming from unforeseen events beyond our control, which include but are not limited to:
- Extreme weather phenomena
- Catastrophic events
- Regulatory enactments
- Shutdowns of ports
- Mechanical breakdowns
10. Privacy and Data Protection
How we handle your personal data complies with our Privacy Policy. You consent to the data collection and use as outlined in our Privacy Policy by employing our services.
11. Intellectual Property
All content present on our site, such as text, images, graphics, and logos, is safeguarded by copyright and trademark laws. You may not replicate, distribute, or create derivative works without our express consent in writing.
12. Governing Law
Laws of Spain govern these Terms, and disputes shall be addressed in courts located within Barcelona, Spain.
13. Changes to Terms
We have the discretion to amend these Terms when necessary. Any revisions will be communicated on our website with an updated revision date. Persistent use of our services signifies acceptance of the revised terms.
